The Veterans Compensation System:

The Veterans Compensation system is designed to compensate veterans with a discharge that is other than dishonorable for injuries that arose out of their time in the service. These claims can include both mental and physical injuries. To start a claim for disability benefits, you need to file a claim with your local regional office of the VA. In Arizona, the regional office is located in Phoenix, Arizona.

If your claim is denied, than you must write a letter stating that you disagree with the decision. The VA will then prepare a "Statement Of The Case". Once you receive the Statement Of The Case, you have 60 days to file a formal appeal with the regional office. This must also be done within one year of receiving the initial denial. Your appeal is called a Notice of Disagreement.

Amount of Benefit Entitlement:
Once a claim is found to be service connected, then they evaluate the degree of permanency related to the condition. There is an extensive rating system. The amount of permanent will determine the amount of money received. 100% disability is currently over $2500 a month. Lesser amounts of permanent means less money. By obtaining 100% disability entitles the veteran to additional benefits for their spouse on death of the veteran if his death was contributed by the service connected condition.

 

When do I need a lawyer?
You are free to consult a lawyer at any time during your case. I would encourage you to do so, the earlier the better. While a lawyer may not technically be able to get into your case to charge a fee, they can advise you as to what to do to give you a better chance of prevailing on your claim. At the notice of disagreement, you can retain an attorney on a contingency fee basis. Attorney's fees are limited to 20% of your back due benefits. There is no fee for the future benefits.
