How It Works
Generally, you have two years from the date that you knew or reasonably should
have known of the negligence of another individual which had caused injuries to
you in which to bring a lawsuit against them. If you are suing a state or
federal entity then you must file an administrative claim within 180 days of the
date of injury before you can file a lawsuit. Claims against state and federal
entities also have a one-year statute of limitation.
It is always better to investigate a claim as soon as possible. You need to make
sure that evidence is preserved and that witnesses are contacted. You should
consult an attorney shortly after the accident so they can help you decide
whether to pursue the claim.
The way personal injury attorneys are usually compensated is based off a
percentage of whatever settlement or verdict they are able to obtain on your
behalf. Usually my fees are 33% of whatever recovery I am able to obtain on your
behalf. If I am able to resolve the case before filing of a lawsuit then I
usually reduce my fee depending on the circumstances.
